The Sale of Goods

Please make sure that you understand these Terms before ordering any goods and note that we may revise these terms from time to time.  By ordering any goods, you agree to be bound by these terms and other documents expressly referred to in them at that time.

Descriptions of Goods

All prices are inclusive of any VAT. Our goods are sold subject to its description and any Special Terms applicable to that particular item. We take care to ensure that all details, description and prices of all goods are correct.

Measurements of Goods

We accept no liability arising from any inaccuracy in the measurements set out in the description of any goods and you are responsible for ensuring there is adequate access to your premises for us to provide delivery of the goods ordered.

It is the customers responsibility that the goods ordered will freely pass through into the room of your choice, if you are in any doubt please contact our sales team before ordering the goods and the suitability of the goods ordered for your chosen location and purpose.

Orders for Goods

A contract for the sale of goods by us to you forms as follows:

You make an offer for the goods then an order gets processed by one of our sales team.  This must be accompanied by a deposit of 20% of the total price of the ordered goods (the ‘Deposit’). 

When the goods become available we will contact you to arrange delivery of the goods and to take payment of the outstanding balance due to us.  Any balance can be settled by cash (only accepted in store), Switch/Maestro, Solo, Visa Debit, Visa Electron, Visa or Mastercard or direct credit to our bank.  Any outstanding payments not covered by a credit agreement must be received by us in full prior to dispatch of the goods. 

We will take reasonable care to keep details of your order and payment secure, but in the absence of our negligence we can’t be held liable for your losses if a third party gains unauthorised access to any data you provided.

If we find the prices of any goods you want to order wrongly priced we don’t have to provide the goods to you at the incorrect (lower) price.

Delivery Lead Times

 Whilst we always try our best to work to the lead times quoted at point of sale. Any date for delivery of the goods is approximate only, and Hills shall not be liable for any delay in delivery of the goods caused by circumstances beyond our control, and therefore no compensation will be paid.

Returns , Cancellations & Refunds

Whilst we do everything that we can to make sure you’re that happy with your order, we do appreciate that items need to be returned from time to time, or you require further contact with us about your purchase.  To help guide you through this process please read this important information regarding our Returns & Cancellation policies below.

Cancellations before delivery

If you have ordered from our Standard ‘In stock’ range, and not subject to the clause below relating to ‘Special Order’ items, you have the right to cancel your order at any time prior to taking delivery. All you need to do is advise us by emailing us at sales@hillsfurniturestore.co.uk .

Any order for ’Special Order’ items may not be cancelled by you, either before or after delivery. This is due to us not being able cancel with our suppliers, as we are obliged delivery ourselves, due to the bespoke nature of the order. Therefore we have no obligation to take back these goods, though we may do so with the incurrence of a 35% restock fee. This is entirely at our discretion.

Once we have acknowledged, receipt of your cancellation, you will receive a full refund minus any restocking fee applicable using the same method as your original payment. This does not affect you statutory rights

Refunds/Returns after delivery

Special Order items – Bespoke means any item, which has been specifically manufactured to your own choice of colour or combination or size. Items where a lead-time is quoted or the terms ‘special order’ appear upon the item description or your order are to be considered bespoke (made specifically for you) and are therefore, as far as is permissible by law. In respect of these items our usual refund policy does not apply and cannot be returned or exchanged unless faulty.

Items from Stock - If you wish to cancel this contract after your order has already been despatched & assembled, we will refund the original purchase price less any restocking charges that we may apply, provided that you have notified us in writing no longer than 7 days after the day on which you receive the Products. The goods must be returned in its original resalable condition. We will arrange to collect the goods and a £30.00 collection fee will be applied. Due to the varied nature of the products that we sell, items like a ‘Large Sliding Wardrobe’ has far more associated costs in returning and restocking than a ‘Lamp Table’. So each individual situation may be dealt with differently.

We do however have some exclusions, due to the nature & hygiene of the following products and once they have been taken out of sealed packaging in which they were delivered. . Mattresses, Divan Beds, and Pillows, & mattress protectors.

Where products are to be returned as unwanted we ask you to contact us to make the necessary arrangements. If the goods are returned for any other reason than being defective, you will be required to arrange and pay for the cost of returning the goods to us. Alternatively we will collect the goods and reserve the right to charge you the direct cost of collection.

Damaged or defective goods

Every effort will be made to ensure that the products you have ordered arrive undamaged and without defect. If the products are found to be either damaged or defective in any way at the time of delivery, you must speak to our delivery team.  If such damage or defect is discovered after delivery, you must contact us within 48 hours of delivery of the product, or in the event of a latent defect, within 48 hours of the date upon which you discovered the defect. All products sold are covered by a 12 month manufacturer guarantee and some products will also be backed by longer warranty/guarantees. Ex Display furniture may have a short guarantee due to them having been on display. Please always talk to us if you have a problem as we are always here to try and help.

Delivery & Storage

If the customer fails to take delivery of the goods or delivery cannot be made due to factors beyond Hills’ control (otherwise than by reason of any cause beyond the customer’s reasonable control or by reason of Hills’ fault) then without prejudice to any other right or remedy available to Hills

 We may:-

Store the goods until delivery and charge the customer for the reasonable associated costs (including transport) of storage.

Sell the goods at the best price readily obtainable and (after deducting all reasonable associated costs) subject to receipt of payment in full of the price of the goods in cash or cleared funds, account to the customer for the excess over the price under the contract or charge the customer for any shortfall below the price under the contract.

Prior to delivery or collection, payment of the balance will be taken and once the goods are deemed to have been delivered or collected, ownership and risk of damage to or loss of the goods shall pass to the customer.

Customers must notify Hills immediately after delivery/collection that an issue exists in order that we can arrange an inspection/return no later than 48 hours following receipt of the goods. 

Notwithstanding delivery and the passing of risk in the goods or any other provision of these terms the legal and beneficial ownership of the goods which are the subject of each contract shall be retained by Hills until Hills have received in cash or cleared funds payment in full of the price of the goods in that contract.

Every effort will be made to ensure that the goods you have ordered arrive undamaged, complete and without defect. The goods must be examined in the presence of our delivery team and if you find a defect you should note it immediately on the delivery note before they leave, which will be passed to our customer service team who will contact you.

Hills are not responsible for personal injury (unless caused by Hills negligence), damage to property or damage arising by reason of inadequate space, access or delivery instruction of any kind. Whilst Hills are responsible for delivery to a customer’s room of choice, the customer is responsible for clearing the route through the property in order to prevent potential damage.

Hills will store goods for a maximum of 4 weeks, subject to space availability. Such a time period will commence upon the date when the customer is notified that the goods are available for delivery. Thereafter the storage charges will be payable by the customer to Hills at a rate equivalent to commercial storage rates.

Risk & Property

Risk of damage or loss of the goods shall pass to the customer upon delivery or collection.

We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.

You agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

Where you have consented to be contacted for marketing/newsletter services, you will receive information from Hills by post, e-mail or telephone, about products, promotions or special offers which we feel may be of interest to you. In the event that you no longer wish to be contacted for such purposes, you may unsubscribe at any time by using the ‘unsubscribe’ function in a marketing email, by emailing sales@hillsfurniturestore.co.uk or by contacting us on 01775 762237, 9am – 5.00pm Monday to Saturday.
